The Government of Sindh Home Department issued the notification no. SO(Jud-I)HD/8-1(04)/2020-Corona-SOPs on 23rd April 2020 at Karachi. This notification is about the Ramzan Taraweeh as per Agreement with Ulama. However, the Government is worried about the health of its citizens and safety measures to protect from Corona Virus. Furthermore, the details of Ramzan Taraweeh as per Agreement with Ulama and their further details are as below;
Order – Ramzan Taraweeh as per Agreement with Ulama.
WHEREAS, in view of the spread of coronavirus and resulting disease (COVID-19) and deaths worldwide and also due to the increasing number of cases in Pakistan as well as in Sindh, the Government of Sindh passed orders from time to time under the SIndh Epidemic Diseases Act 2014 (The SIndh Act VIII of 2015).
WHEREAS, Government of Sindh, in constitution with Medical Experts and received inputs from the religious leaders and scholars from all schools of thought, who unanimously announced that if deemed necessary the Government, for medical reasons, may place any restrictions on the number of persons offering prayers by Jamaat in Masjid. And Whereas the Government received directions/ recommendations from the medical experts on disease spread of COVID-19 and accordingly passed orders dated 26th March and 2nd April 2020 under the SIndh Epidemic Diseases Act, 2014 (Sindh Act VIII of 2015) to place restriction of a number of persons offering congregational prayers.
AND WHEREAS the Federal Government in consultation with Provinces, GB, AJK and ICT at NCC (National Coordination Committee) engaged with the Ulema and the President of Pakistan reached a 20 point agreement on conditionally conducting mandatory congregational prayers/ Fraz Namaz at Mosques keeping in view COVID-19 situation and whereas the Government of SIndh considers that the same requires to be implemented.
NOW THEREFORE, in excercise of powers Under Section 3(1) of the Sindh Epidemic Diseases Act 2014 (The Sindh Act VIII of 2015) the Government of Sindh is pleased to issue following Order specific for Taraweeh prayers, that:
Keeping in view the increasing number of COVID-19 cases and based on consultations and inputs from the doctors and experts on COVID-19 as well as per the agreement with Ulema, as referred above, the Government hereby directs all concerned that Taraweeh Namaz/ Prayers, being not mandatory/ Farz Namaz, shall be offered at home as per Sunnah.
This order shall come in force immediately with effect from 23rd April 2020 and shall continue till further orders or till the end of Ramazan.
Any person found violating any of the instructions contained in these SOPs shall be liable for action in accordance with law as per section 4 of the Sindh Epidemic Disease Control Act 2014.
Deputy Commissioner, Assistant Commissioner, as well as personnel of Law Enforcement Agencies not below the rank of Inspector Police (or of equivalentrank for other Law Enforcement Agencies), are empowered under Section 3(1) of the said Act to take any legal action on any contravention of this order or directions/ notices issued thereunder, including action under Section 188 of Pakistan Penal Code 1860.
